Refund Policy

Black Mountain AI Pty Ltd (trading as BuildForge) (ABN 87 673 936 448) ("BuildForge", "we", "us", "our") is committed to fair and transparent billing practices. This Refund Policy explains your rights regarding cancellations and refunds for our Services.
1. Free Trial
All new accounts receive a 14-day free trial. No payment information is required to start a trial. During the trial period:
- You have access to the Professional plan features
- You can cancel at any time with no charge
- If you do not select a paid plan before the trial ends, your account will be downgraded to read-only access
- Your data is preserved for 90 days after the trial ends
2. Monthly Subscriptions
2.1 Cancellation
You may cancel your monthly subscription at any time through your account settings. Upon cancellation:
- Your subscription remains active until the end of the current billing period
- You will not be charged for the next billing period
- No partial refund is issued for the remaining days of the current billing period
2.2 Refunds
Monthly subscriptions are generally not refundable. However, we will consider refund requests on a case-by-case basis if:
- You were charged in error (e.g., duplicate payment)
- The Services were materially unavailable for an extended period
- You experienced a significant technical issue that prevented use of the Services
3. Annual Subscriptions
3.1 Cancellation
You may cancel your annual subscription at any time. Upon cancellation:
- Your subscription remains active until the end of the current annual billing period
- Your subscription will not auto-renew at the end of the period
3.2 Refunds
- Within 30 days of purchase or renewal: You may request a pro-rata refund for the unused portion of your annual subscription. The refund will be calculated from the date of your refund request to the end of the annual period.
- After 30 days: No refund is available. Your subscription remains active until the end of the annual period.
4. Downgrades
If you downgrade from a higher-tier plan to a lower-tier plan:
- The downgrade takes effect at the start of the next billing period
- No refund or credit is issued for the difference in the current period
- Features exclusive to the higher-tier plan will become unavailable upon downgrade
5. Upgrades
If you upgrade to a higher-tier plan:
- The upgrade takes effect immediately
- You will be charged the prorated difference for the remainder of the current billing period
- Subsequent billing periods will be charged at the new plan rate
6. Australian Consumer Law Guarantees
Our Services come with guarantees that cannot be excluded under the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law). Nothing in this Refund Policy limits or excludes any consumer guarantee.
Under Australian Consumer Law, you are entitled to a remedy (including a refund) if:
- The Services have a major failure (i.e., they would not have been acquired by a reasonable consumer if they had known about the failure)
- The Services do not meet a consumer guarantee and the failure cannot be remedied
- The Services do not meet a consumer guarantee, the failure can be remedied, but it is not remedied within a reasonable time
If the failure is minor and can be remedied, we may choose to remedy the failure instead of providing a refund.
7. How to Request a Refund
To request a refund, please contact our billing team:

- Include your account email address, the reason for your refund request, and any relevant details
We will acknowledge your request within 2 business days and process approved refunds within 10 business days. Refunds are issued to the original payment method.
8. Billing Disputes
If you believe you have been incorrectly charged, please contact us at billing@buildforge.com.au before initiating a chargeback with your bank. We are committed to resolving billing disputes promptly and fairly.
9. Changes to This Policy
We may update this Refund Policy from time to time. Material changes will be notified by email at least 30 days before they take effect. The updated policy will apply to subscriptions renewed after the effective date.
